Model releases for video and other models ensure that the model states that:

• She or he is aware of the nature of her employment

• She or he waives all rights the materials and transfers all ownership to the producer

• She or he consents to use of her name, image, voice

• She or hehe is over 18 (be sure to get and retain proper proof of age)

• She or he releases all claims against the producer/distributor

Without a model release, a model has a host of possible claims against the content creator and anyone distributing or using the content. These could include the following:

• Violation of her rights of publicity, which cover the use of any person's image, voice, likeness or name in a commercial endeavor

• Violation of his rights of privacy, which prohibit the use of private information or images of any person
  

• Claims of being unaware of the age requirements or nature of the work, or use of the content
  

• Claims of misuse of the content
  

• Claims of libel or slander by the model regarding the content
  

• Trademark claims if the model's name is famous enough to merit trademark status

Model release forms are a good start in your business. It is equally important to use the correct contractor and/or service level agreements to be sure that you own the work product produced by any persons you hire as contractors.
